Terms of Service

These proposed terms describe use of Kitchen Magic, a web service for importing, organizing, editing, cooking from and privately sharing recipes. “We” and “us” refer to the operator of Kitchen Magic, whose legal identity must be confirmed before these terms take effect.

1. Your account and permitted use

The proposed tester service is for people aged 18 or older who can enter a binding agreement. Sign in with your own Google account, protect access to it, and provide accurate information. Tell us promptly if you believe your Kitchen Magic account has been misused.

Subject to these terms, you may use the service for your personal recipe library and available sharing features. You may not access private content without authorization, bypass access or usage controls, introduce malicious software, disrupt the service, impersonate others, or use it for unlawful activity.

Reasonable security and usage limits may apply. Access to an AI feature does not promise unlimited processing or uninterrupted availability.

2. Your content and permissions

You keep whatever rights you already have in content you add. Importing material does not give you ownership of someone else’s work or permission to redistribute it. You must have the rights or other lawful basis needed to import, use and share that material.

You grant us a non-exclusive license to host, copy, format, process through our service providers, and display your content only as needed to operate the service and carry out your requests, including the sharing permissions you choose. This is not permission to sell your recipes or use them to train our own AI models.

This operating license lasts while content is needed for those purposes, including applicable retention and authorized shared copies described in the Privacy Policy. Our software, branding and designs remain ours or our licensors’; using the service does not transfer those rights to you.

3. AI, recipes and food safety

AI output and imported recipes may be inaccurate, incomplete or unsafe. Review them before relying on them. Errors can affect ingredients, allergens, units, substitutions, serving sizes, equipment, temperatures, cooking times and nutrition information.

Compare results with the original, check ingredient labels and cross-contact risks, and follow reliable food-safety guidance. Use appropriate judgment and equipment when cooking. Do not rely on the service to determine whether food is safe or suitable for an allergy, medical condition or special diet.

Kitchen Magic is an organizational and cooking-assistance tool, not medical, dietary or professional food-safety advice. We do not warrant the correctness, safety, originality or legal suitability of submitted or generated content. Obtain qualified advice when needed.

You decide what to save, share and cook. These responsibilities do not exclude any duty or liability that applicable law does not allow us to exclude.

4. Sharing, storage and third parties

Check the recipient and permissions before sharing. Household access and a private invitation to one recipe have different effects. A recipient’s independently saved copy can remain after you revoke an invitation or delete your own copy.

Keep your own backup of important recipes. Export and available recovery tools can help, but are not a guarantee against loss. Deletion, account requests and retained copies are described in the Privacy Policy.

Sign-in, hosting, AI processing, email delivery and external recipe sources involve third parties whose services may change or become unavailable. External links are not endorsements, and their content and practices are subject to their own terms. This does not remove our responsibilities for our service under applicable law.

5. Testing and future paid plans

Testing currently does not require payment. Kitchen Magic does not currently activate paid subscriptions or automatically charge you. Displayed launch prices and recipe capacities are proposed plans, not current tester limits or a promise of a future offer.

Before any paid enrollment, the applicable price, features, billing, renewal, cancellation and refund terms must be presented for agreement. Nothing in this draft authorizes a charge.

6. Warranty disclaimer

To the fullest extent permitted by applicable law, the service is provided “as is” and “as available,” without express or implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not promise uninterrupted or error-free service, perfect security, preservation of every item, or accurate results from imports, AI features or third-party sources.

Mandatory consumer guarantees and any warranties that cannot lawfully be excluded remain in place.

7. Proposed limits of liability

To the fullest extent permitted by applicable law, Kitchen Magic’s operator and its owners, officers, employees and agents will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or lost profits, revenue, business opportunities, goodwill or data arising from the service or these terms.

Subject to the exceptions below, their combined total liability for claims arising from the service or these terms is proposed to be limited to the greater of US $100 or the amount you paid Kitchen Magic for the service during the 12 months before the event giving rise to the claim. This proposed cap requires operator and jurisdiction-specific legal review before adoption.

These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited. They do not override mandatory consumer or privacy rights.Nothing here promises immunity from a claim or from legal obligations.

8. Claims arising from misuse

Where permitted by applicable law, you agree to reimburse the operator for reasonable third-party claim costs, including reasonable legal fees, to the extent caused by your unlawful content, infringement of another person’s rights or deliberate misuse of the service in breach of these terms. This does not cover claims caused by our own wrongdoing or obligations the law requires us to bear.

We must notify you of the claim and reasonably cooperate. No settlement may impose an admission or non-monetary obligation on you without your consent. This proposed provision also requires local-law review.

9. Suspension, ending use and changes

You may stop using the service at any time. We may restrict or suspend access when reasonably necessary to address misuse, security risks or legal requirements. Where practicable and legally appropriate, we will explain the reason and provide a way to raise a mistake with us.

Features may change or be discontinued. Where reasonably practicable, we will give advance notice of a material discontinuation so you can export your recipes. This does not guarantee availability in an emergency or excuse mandatory obligations.

Material changes to effective terms require appropriate notice and renewed agreement where the law requires it. We do not treat merely viewing this draft as agreement, backdate acceptance, or retroactively expand permissions to use your content.

10. Applicable law and general provisions

This draft does not select a state, country, exclusive court or arbitration forum while the operator’s location and intended markets remain unconfirmed. Applicable mandatory law and access to courts are not waived. No mandatory arbitration or class-action waiver is added.

If a provision is unenforceable, the remaining provisions continue only to the extent permitted by law. A failure to enforce a provision is not a waiver of future enforcement. Statutory rights remain unaffected.
